Terms of Use (The Velvet Junction)

These Terms of Use (“Terms”) govern your access to and use of The Velvet Junction website, apps, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

If you do not agree, do not use the Services.

1) Adults only (18+)

The Services are intended only for adults who are 18 years of age or older (or the age of majority in your jurisdiction, if higher).

By accessing or using the Services, you represent and warrant that:

you are at least 18 (or older where required), and
you will not allow any minor to access the Services through your account, device, or network.

We may require age verification and may suspend or terminate access if we reasonably believe you are underage.

2) Adult content and consent expectations

The Services may include adult, sexually explicit, and suggestive content. You acknowledge that:

you may be exposed to adult content,
you choose to access the Services voluntarily,
you are responsible for ensuring access is legal where you are located.

Consent and boundaries: You agree to engage respectfully and to stop any interaction if asked. You must not attempt to coerce, threaten, harass, or exploit anyone.

3) Service nature (AI/virtual interactions) + no professional advice

The Velvet Junction provides entertainment experiences, which may include AI-driven or virtual interactive content and conversations.

You understand and agree that:

the Services are for entertainment purposes only,
any statements made through the Services are not professional advice (medical, legal, financial, or otherwise),
you are responsible for your decisions and actions.

4) Account registration and security

To use certain features, you may need an account (including via Google/Gmail authentication). You agree to:

provide accurate information,
keep your login credentials secure,
notify us promptly of unauthorized use.

You are responsible for all activity on your account.

5) Recordings and transcripts

To operate the Services, calls may be recorded and transcribed using third-party providers.

By using call features, you consent to:

recording and transcription of calls,
storage and processing of recordings/transcripts for service delivery, quality assurance, safety, dispute handling, and enforcement.

Do not use call features if you do not consent.

6) Payments, credits, and subscriptions

Certain features may require payment, credits, or subscriptions.

You agree that:

all prices are shown at checkout and may include taxes where applicable,
payments are processed through third-party processors (e.g., Stripe),
access to paid features may be revoked if payment fails, is reversed, or is disputed.

Credits / usage-based billing (if applicable):

Credits have no cash value, are non-transferable, and may not be resold.
Credits may expire if stated at the time of purchase or in your account.

Refunds:

Unless required by law, purchases are final and non-refundable, including for partially used credits, unused time, dissatisfaction, mistaken purchases, or account termination due to policy violations.
If you believe you were charged in error, contact support promptly.

7) Prohibited conduct

You agree not to use the Services to:

A) Exploit or endanger minors

Any content involving minors, or that depicts/encourages exploitation of minors, is strictly prohibited and will be reported as required by law.

B) Illegal, harmful, or abusive activity

Threaten, harass, stalk, defame, or abuse others
Promote or facilitate violence, self-harm, or illegal acts
Share non-consensual sexual content, revenge porn, or doxxing
Impersonate any person or misrepresent your identity
Attempt to obtain personal data from others (e.g., addresses, financial details)
Upload or transmit malware, spam, or attempt to hack or disrupt the Services

C) Platform misuse

Reverse engineer, copy, scrape, or attempt to extract source code, prompts, models, or system logic
Circumvent safety features, age gates, or access restrictions
Use bots or automation without our written permission

We may remove content, suspend access, or terminate accounts at any time for violations.

8) User content and permissions

You may submit content through the Services (e.g., messages, prompts, feedback) (“User Content”). You represent that you have the rights to submit it and that it does not violate law or these Terms.

To operate the Services, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, and display User Content solely for:

providing and improving the Services,
moderation and safety enforcement,
dispute handling and legal compliance.

You retain ownership of your User Content subject to this license.

9) Intellectual property

The Services, including all software, design, branding, and content we provide (excluding User Content), are owned by The Velvet Junction or its licensors and are protected by intellectual property laws.

You may not copy, distribute, modify, or create derivative works from our Services except as expressly permitted.

10) Moderation, enforcement, and termination

We may (but are not required to) monitor, moderate, or review activity on the Services.

We may suspend or terminate your access (with or without notice) if we believe you:

violate these Terms,
pose a risk to others or the platform,
attempt fraud, chargebacks, or abuse of payment systems.

Termination may result in loss of access to content, credits, or subscriptions, to the extent permitted by law.

11) Third-party services

The Services may rely on third-party platforms (e.g., hosting providers, payment processors, analytics providers, transcription providers). We are not responsible for third-party services and their terms/policies.

12) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted operation, error-free performance, or that any content will meet your expectations.

13) Limitation of liability

To the maximum extent permitted by law:

The Velvet Junction will not be liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability for any claim relating to the Services will not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim (or $100, whichever is greater), unless a different minimum is required by law.

Some jurisdictions do not allow certain limitations; in that case, limitations apply to the fullest extent permitted.

14) Indemnification

You agree to indemnify and hold harmless The Velvet Junction, its affiliates, and personnel from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from:

your use of the Services,
your violation of these Terms,
your User Content,
your violation of any law or third-party rights.

15) Dispute resolution, arbitration, and class-action waiver (US-focused)

Please read carefully. This section affects your rights.

Unless prohibited by law, any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis and not in a class, collective, or representative action.

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally.

If arbitration is not permitted in your jurisdiction, disputes will be resolved in the courts described in Section 16.

16) Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.

We may update these Terms from time to time. We will post the updated version with a new “Last updated” date. Your continued use after changes means you accept the updated Terms.
